The Technical Prevention Note No. 1,071 of the National Institute for Safety and Health at Work establishes the obligation on the part of the developer of the works to collect relevant information on the risks that may arise in the work and, consequently, on the measures that must be adopted. This obligation is covered by the drafting of this document.

The objective of this study is to prevent possible accidents during the execution of the work, since this document contains the necessary technical prevention and protection measures to carry out the work in ideal safety and health conditions. Works with a Project will include, as one more chapter of the same, the Basic Study or Safety and Health Study in accordance with RD 1627/1997.

This document applies in construction works “without a project” both to the figure of the Contractor (when contractually assumes with the Developer the execution of the work) and also to the figure of the Developer when it directly contracts with freelancers the execution of the work.

The Plan is an obligation of the contractor of the work, which is defined in RD 1627/1997, article 2, section 1.h., as the natural or legal person who contractually assumes before the Developer, with its own or others’ human and material resources, the commitment to execute all or part of the works subject to the project and the contract. That is, it is the company that the property hires to carry out all or part of the work.

Drafting of emergency and self-protection plans (NBA 2007), including registration with the corresponding official body, implementation, carrying out evacuation drills and maintenance thereof.
